Terms and Conditions of Participation

These Terms and Conditions set out what you’re agreeing to when you, or a Minor you register, take part in a Kids Giving Back Event. Please read them carefully before you register.
By registering, you agree to be bound by these Terms and Conditions, in relation to your own participation and that of any Minor you register. If you’re registering on behalf of a Minor, you’re confirming that you have the authority to agree to these Terms on their behalf, and that you have explained them to the Minor in a way they can understand.
1. Definitions
- Event: the relevant program or event organised by the Event Organiser that you or a Minor is registered to participate in.
- Event Organiser: Kids Giving Back, and its agents, sponsors, partners and suppliers.
- Minor: a person aged under 18 that you register for an Event.
- Participant: you (if you’re taking part) and any Minor you register.
2. Eligibility and Parental Authority
For all Events that permit a Minor to participate, the minimum age to participate is set out in the details of the relevant program. You must be at least 18 years old to register a Minor for an Event. By registering a Minor, you confirm that you are their parent, legal guardian, or otherwise have the authority to make the decision to participate on their behalf.
3. Cancellations
We understand things come up from time to time where you are no longer able to attend an Event you have booked. Please refer to the Kids Giving Back Cancellation & Refund Policy for our cancellation terms.
4. Safety
Events may involve being around people, tools and equipment that could be hazardous (for example use of knives in cooking programs).
You agree, and will ensure any Minor you register agrees, to follow all reasonable directions from the Event Organiser staff and personnel, follow safety instructions, wear any required safety equipment, and wear appropriate clothing at all times during the Event.
All Participants participate at their own risk.
5. Food Allergy
Certain Events involve preparation and cooking food that may contain allergens. Despite best efforts, we cannot guarantee that our facilities and venues that host the Event will be allergen free. If a Participant has a food allergy, this must be disclosed to the Event Organiser and you agree to ensure that any Participant you register has access to any necessary medication at the Event.
6. Personal Responsibility
Each Participant is responsible for their own safety and for the security of their personal belongings at the Event. To the maximum extent permitted by law, the Event Organiser does not accept responsibility for loss, damage or harm to a Participant’s personal wellbeing or property.
7. Photo, Video and Image Consent
During registration, you will be asked whether you consent to photos or video of you, and any Minor you register, being taken during or at the Event. If you choose to give consent, you authorise the Event Organiser, its authorised agents and its sponsors to use those photos or videos in any form of media, including print, digital, social media and promotional materials, without further approval or payment to you.
We will not disclose identifying information about a Minor (such as their full name, school or address) alongside their image without your separate, express consent.
You can withdraw this consent at any time by emailing info@kidsgivingback.org. Withdrawing consent won’t affect photos or video already published before we receive your request.
This consent applies separately to each Event you register for.
8. Waiver, Release and Discharge
To the maximum extent permitted by law, you release, waive and discharge the Event Organiser and its contractors, partners, employees, agents, directors, representatives, successors, assignees, licensees and volunteers (the Released Parties) from any and all loss arising from your participation in the Event, including:
- claims and actions for property damage, death, injury or illness of any Participant;
- liability arising from actual or alleged fault, acts or omissions of the Released Parties; and
- loss, damage, costs or expenses arising from a Participant’s participation in the Event, or related activities before or after it.
You agree to indemnify the Released Parties against claims brought against them arising from, or in connection with, your or any Participant’s participation in the Event.
9. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia, and by registering to participate you and any Minor whom you register submit to the non-exclusive jurisdiction of its courts.
10. Privacy
During registration you will be asked to consent to the collection, use, disclosure and management of your (and on behalf of the Minor where applicable) personal information.
The Event Organiser collects a Participant’s personal information so they can take part in the Event. Without this information, a Participant may not be able to participate. You can request access to, or correction of, a Participant’s personal information at any time by contacting the Event Organiser.
